Short answer: in general, a person must have reached the age of majority to sign a contract like a waiver on their own. That age is 18 in most U.S. states, 19 in Alabama and Nebraska, and 21 in Mississippi. In Canada it is 18 or 19 depending on the province. Anyone younger is generally a minor, and waivers for minors are usually signed by a parent or legal guardian.

Why age matters for a waiver
A waiver is a contract. In the U.S. and Canada, minors generally lack the legal capacity to make binding contracts, so a minor can usually cancel, or "disaffirm," a contract they signed. A waiver signed only by a 16 year old may therefore give the host very little protection. That is why waivers for minors are signed by a parent or legal guardian, and why it helps to know exactly where the line is.
A parent's signature is not a cure-all either. Some states enforce a parent's waiver of a child's claims, some do not, and some only for certain activities. See can a parent sign a waiver for a minor for more on that.

Courts in several Canadian provinces have been reluctant to enforce waivers signed by parents on behalf of children. Waivers involving Canadian minors are an area where local legal advice is especially worthwhile.
The 18 to 20 gray zone: an 18 year old from Nebraska, or a 20 year old from Mississippi, is generally still a minor at home. Simple Waivers asks signers in that age range whether they are an adult where they live and records the answer on the signed PDF. Whether to also require a parent's signature is a decision for each host and their attorney.
How hosts commonly handle minors
- A parent or legal guardian signs. They sign on the minor's behalf and often also agree personally to the release and indemnity.
- The minor's age or date of birth is recorded. This documents that the participant was known to be a minor.
- One waiver per child. A parent with three children completes one for each, so every record names the right participant.
- Records are kept. In many places a minor can bring a claim for a period after reaching adulthood, so hosts often keep waivers for minors for years. Ask an attorney how long to keep yours.
Frequently asked questions
Can a 17 year old sign a waiver?
Generally a 17 year old is a minor in every U.S. state, and a minor can usually cancel a contract they signed, including a waiver. That is why waivers for minors are usually signed by a parent or legal guardian, and how much effect that has depends on the state. Emancipated minors can be an exception.
Can an 18 year old sign a waiver in Nebraska or Alabama?
The age of majority is 19 in Nebraska and Alabama, so an 18 year old there is generally still a minor for contract purposes, unless an exception such as emancipation or marriage applies.
What is the age to sign a waiver in Mississippi?
Mississippi generally sets the age of majority at 21 for contracts, with some exceptions, so people under 21 there are generally minors for contract purposes.
Does an emancipated minor need a parent to sign?
A minor who has been legally emancipated by a court, or in some states by marriage or military service, can often sign contracts as an adult. Rules vary by state, so ask for proof and check local law.
Which age applies, the signer's home state or where the activity happens?
It can depend on the waiver's choice of law clause and on which court hears a claim. Many waivers, including our template, choose the law of the place where the activity takes place. This is a good question to put to an attorney if your participants come from many places.
