Release of Liability and Assumption of Risk

The individual named below (referred to as "I" or "me") desires to participate in [ACTIVITY] (the "Activity") organized by [EVENT ORGANIZER / HOST] (the "Organizer"). In consideration of being permitted to participate in the Activity, the value that I will gain by participating, and the Organizer's reliance on this instrument, I agree to all the terms and conditions set forth in this instrument (this "Release").

Assumption of Risk. I AM AWARE AND UNDERSTAND THAT THE ACTIVITY IS A POTENTIALLY DANGEROUS ACTIVITY AND INVOLVES THE RISK OF PERSONAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, TEMPORARY OR PERMANENT DISABILITY, DEATH, PROPERTY DAMAGE, AND/OR FINANCIAL LOSS. I ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN MAY RESULT FROM OR BE COMPOUNDED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF THE ORGANIZER, INCLUDING NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS OF THE ORGANIZER. NOTWITHSTANDING THE RISK, I ACKNOWLEDGE THAT I AM KNOWINGLY AND VOLUNTARILY PARTICIPATING IN THE ACTIVITY WITH AN EXPRESS UNDERSTANDING OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE ARISING FROM MY PARTICIPATION IN THE ACTIVITY, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF THE ORGANIZER OR OTHERWISE.

Additional Terms (if any) are binding and form part of this agreement.

Release and Waiver of Liability. I HEREBY EXPRESSLY WAIVE AND RELEASE ANY AND ALL CLAIMS, NOW KNOWN OR HEREAFTER KNOWN, AGAINST THE ORGANIZER AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, "RELEASEES"), ARISING OUT OF OR ATTRIBUTABLE TO MY PARTICIPATION IN THE ACTIVITY, WHETHER ARISING OUT OF THE ORDINARY NEGLIGENCE OF THE ORGANIZER OR ANY RELEASEES OR OTHERWISE. I COVENANT NOT TO MAKE OR BRING ANY SUCH CLAIM AGAINST THE ORGANIZER OR ANY OTHER RELEASEE, AND FOREVER RELEASE AND DISCHARGE THE ORGANIZER AND ALL OTHER RELEASEES FROM LIABILITY UNDER SUCH CLAIMS. THIS WAIVER AND RELEASE DOES NOT EXTEND TO CLAIMS FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY OTHER LIABILITIES THAT CANNOT BE RELEASED BY AGREEMENT UNDER APPLICABLE LAW.

Indemnification. I shall defend, indemnify, and hold harmless the Organizer and all other Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorney fees and costs of enforcing any right to indemnification under this Release, and the cost of pursuing any insurance providers, incurred by the Organizer or any other Releasees arising out of or resulting from any claim of a third party related to my participation in the Activity, including any claim related to my own negligence or the ordinary negligence of the Organizer.

Medical Consent. I hereby consent to receive medical treatment deemed necessary if I am injured or require medical attention during my participation in the Activity. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and/or evacuation. I hereby release, forever discharge, and hold harmless the Organizer and all other Releasees from any claim based on such treatment or other medical services.

Participant Representations. I represent that I am at least the age of majority in the place where the Activity takes place and am legally competent to sign this Release, or, if I am not, that this Release is being signed for me by my parent or legal guardian as described below. I represent that I am physically and mentally able to participate in the Activity, and I agree to follow the rules and instructions of the Organizer.

Miscellaneous. This Release constitutes the sole and entire agreement of the Organizer and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release or invalidate or render unenforceable such term or provision in any other jurisdiction, and any such term or provision shall be enforced to the maximum extent permitted by law. This Release is binding on and shall inure to the benefit of the Organizer and me and our respective heirs, successors, and assigns. All matters arising out of or relating to this Release shall be governed by and construed in accordance with the laws of the state, province, or other jurisdiction in which the Activity takes place, without giving effect to any choice or conflict of law provision or rule. Any claim or cause of action arising under this Release may be brought only in the courts located in that jurisdiction, including any federal courts for that jurisdiction, and I hereby consent to the exclusive jurisdiction of such courts.

Minor Participant and Guardian Acknowledgment. If the participant is under the age of majority in the place of the Activity, I represent that I am the participant's parent or legal guardian and have full legal authority to sign this Release on the participant's behalf. I agree, both personally and as the participant's parent or guardian, to the release of claims in this Release and to defend, indemnify, and hold harmless the Releasees from any claims or liabilities arising from the participant's participation. If any part of this Release cannot be enforced against the participant, it remains binding on me personally to the fullest extent permitted by law.

Electronic Signature Consent. I consent to execute this Release electronically. I understand that my electronic signature, and if I am signing as a parent or legal guardian for a minor, my electronic signature on the minor's behalf, is the legal equivalent of a handwritten signature and is binding and enforceable. I agree that the electronic record of this Release, including the signing details recorded with it, is an accurate record of my agreement, and that I may keep a copy of it.

BY SIGNING, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE, THAT I AM SIGNING IT FREELY AND VOLUNTARILY, AND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE ORGANIZER.
