Free Pool Waiver Template for Rentals and Backyard Pools

A pool is the amenity guests book for and the one most likely to cause a serious injury. If you rent out a home with a pool or host friends and family around your own, a signed waiver is a simple way to make sure every adult has read your pool rules and accepted the risks before anyone gets in the water.

Below are free pool terms you can copy. They are written to sit inside a full release of liability, like our free liability waiver template, as the property-specific section.

How to use this template

  1. Start with a full release of liability. Simple Waivers includes one, and you can read it on the free liability waiver template page.
  2. Copy the pool terms below and edit them to match your property and rules.
  3. Add them as the property-specific section, then send guests one link or QR code to sign before they arrive.

Pool Terms. I understand that swimming and using the pool, pool deck and any pool equipment involve risks including slipping, falling, drowning, near drowning, head and spinal injuries from diving, and illness from water or chemicals. No lifeguard is on duty, and I and every person in my group swim at our own risk.

I agree to follow all posted pool rules and any rules the Organizer gives me, including: no diving unless the Organizer has marked an area as safe for diving; no running on the pool deck; no glass near the pool; no swimming alone; and no swimming while impaired by alcohol or drugs.

Children must be actively watched by a responsible adult at all times while in or near the pool, and I accept responsibility for supervising any minors in my group. I will make sure that any pool gate, cover or alarm is closed or reset after use.

I will stop using the pool and tell the Organizer right away if I notice broken equipment, unclear water, a missing drain cover or any other unsafe condition.

This is sample wording to start from, not legal advice and not a guarantee of protection. Edit it to fit your property, and have an attorney licensed where your property is located review it before you rely on it.

What these terms cover

  • The specific risks of swimming, diving and wet pool decks, so the signer cannot later say they were not warned.
  • That no lifeguard is on duty.
  • Your core pool rules: no diving except in marked areas, no running, no glass, no swimming alone or impaired.
  • Adult responsibility for supervising children, which matters because a waiver signed for a child is treated differently from state to state.
  • A duty to report hazards instead of using a pool that looks unsafe.

Tips before you use it

  • Post the same rules at the pool itself. A waiver works best when the rules guests agreed to are also visible where the risk is.
  • Edit the diving line to match your pool. If your pool is too shallow for diving anywhere, say so plainly.
  • If your pool has a slide, a diving board or a heater, add a sentence for each.
  • Many states have pool fencing and gate rules for rentals. A waiver does not replace those.

Frequently asked questions

Do I need a pool waiver for my Airbnb?

That is a decision for you, ideally with your insurer and an attorney. Many hosts with pools choose to use one so each adult guest acknowledges the pool rules and the risks before arrival. A waiver works alongside insurance, not instead of it. Check your booking platform's current host policies too.

Can a parent sign a pool waiver for a child?

A parent or guardian can sign on a child's behalf, but how much legal effect that has depends on the state. See can a parent sign a waiver for a minor.

Does a pool waiver protect me if someone drowns?

A waiver can help with claims based on ordinary negligence in many states, but it does not cover gross negligence and cannot replace safe conditions, proper fencing and insurance. Have a local attorney review your wording.
