We reserve the right to withdraw or amend this Website, and any service or material we provide on the Website, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Website is unavailable at any time or for any period. From time to time, we may restrict user access, including registered user access, to some parts of the Website or the entire Website.

You are responsible for both:

• Making all arrangements necessary for you to have access to the Website.
• Ensuring that all persons who access the Website through your internet connection are aware of these Terms of Use and comply with them.

To access the Website or some of the resources it offers, you may be asked to provide certain registration details or other information. You agree to notify us immediately of any unauthorized access to or use of your username or password or any other breach of security. You also agree to ensure that you exit from your account at the end of each session. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

We have the right to disable any username, password, or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms of Use.

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• You may print or download one copy of a reasonable number of pages of the Website for your own lawful internal use and not for further reproduction, publication, or distribution.
• If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own lawful internal use, provided you agree to be bound by our end user license agreement for such applications.
• If we provide social media features with certain content, you may take such actions as are enabled by such features.

You must not:

Your Waiver Content

When you create waivers, events, or other content using our Website ("Your Content"), you retain all ownership rights in Your Content. By submitting Your Content to the Website, you grant the Company a non-exclusive, worldwide, royalty-free license to store, display, reproduce, and process Your Content solely for the purpose of operating and providing the Website and its services to you. This license ends when you delete Your Content from our systems or when your account is terminated, subject to our data retention policies.

We will not use Your Content for marketing, advertising, or any purpose unrelated to providing the Website and its services to you. We will not sell, license, or distribute Your Content to third parties, except as necessary to provide the services you have requested (for example, generating and delivering waiver PDFs to your guests).

You represent and warrant that you have all necessary rights to submit Your Content and that Your Content does not violate any applicable law or infringe any third-party rights.

Your Responsibility for Your Waivers; Minors; Enforceability

Simple Waivers provides software that lets you present a waiver and collect electronic signatures. You, the host, decide whether to use a waiver, which waiver text and options to use, who signs it, and whether to rely on it. You are solely responsible for those decisions and for complying with the laws that apply where your activity takes place, including laws in states, provinces, and countries outside the United States.

Minors. The Website lets a parent or legal guardian sign on behalf of a participant who is a minor. Offering this feature is not a statement that a parent or guardian may waive a minor's rights, or release claims on a minor's behalf, where your activity takes place. In many places, including many U.S. states and Canadian provinces, a waiver or release signed by a parent or guardian for a minor may be unenforceable in whole or in part. Whether to collect parent or guardian signatures, and what effect they have, is your decision and your responsibility. You should consult an attorney licensed where your activity takes place.

No guarantee of enforceability. The Company does not guarantee that any waiver, release, assumption of risk, indemnity, or electronic signature collected through the Website will be valid, enforceable, or effective to limit any liability, in any jurisdiction or for any participant. The Company makes no representation that any waiver template or option is suitable or lawful for your activity, location, or participants.

Not a party; not insurance; not safety advice. Each waiver collected through the Website is an agreement between the host and the person who signs it. The Company is not a party to any waiver and is not an organizer, operator, sponsor, or supervisor of any host's activity. The Website is not insurance, does not replace liability insurance, and is not safety, risk management, or legal advice. You remain responsible for operating your activity safely, for your own insurance, and for any injury, loss, or claim arising from your activity.

Your records. You are responsible for keeping copies of your signed waivers for as long as you may need them, including for the full period in which a claim could be brought where your activity takes place, which can be longer when the participant is a minor. You can download signed waivers from your dashboard at any time while your account is active. If you know of an injury, claim, complaint, or dispute, you must not delete the related waivers.

The Disclaimers page forms part of these Terms of Use. Your indemnification obligations below include claims by participants, guests, parents, guardians, or anyone else arising out of your activity, your waivers, or your use of the Website to collect signatures.

Trademarks

The Company name, the Company logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs, and slogans on this Website are the trademarks of their respective owners.

• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing).
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Website, or which, as determined by us, may harm the Company or users of the Website, or expose them to liability.

Additionally, you agree not to:

• Use any device, software, or routine that interferes with the proper working of the Website.
• Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.

Monitoring and Enforcement; Termination

We have the right to:

• Remove or refuse to post any User Contributions for any or no reason in our sole discretion.
• Take any action with respect to any User Contribution that we deem necessary or appropriate in our sole discretion, including if we believe that such User Contribution violates the Terms of Use, including the Content Standards, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Website or the public, or could create liability for the Company.
• Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.
• Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Website.

Without limiting the foregoing, we have the right to cooperate fully with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through the Website.

YOU WAIVE AND HOLD HARMLESS THE COMPANY AND ITS AFFILIATES, LICENSEES, AND SERVICE PROVIDERS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY ANY OF THE FOREGOING PARTIES DURING, OR TAKEN AS A CONSEQUENCE OF, INVESTIGATIONS BY EITHER SUCH PARTIES OR LAW ENFORCEMENT AUTHORITIES.

However, we do not undertake to review all material before it is posted on the Website and cannot ensure prompt removal of objectionable material after it has been posted. Accordingly, we assume no liability for any action or inaction regarding transmissions, communications, or content provided by any user or third party. We have no liability or responsibility to anyone for performance or nonperformance of the activities described in this section.

Reliance on Information Posted – No Engagement to Provide Legal Services

The information presented on or through the Website is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information.

Company is not a law firm or otherwise engaged in the practice of law, and is prohibited from providing legal services that must be performed by a licensed attorney. Accordingly, use of this Website and the information it provides does not constitute the engagement of an attorney, and Company has not been so engaged. Company and its forms are not a substitute for the advice or services of an attorney.

For example, the Company will not review your answers for legal sufficiency, draw any legal conclusions on your behalf, provide legal advice, opinions or recommendations about your legal rights, remedies, defenses, options, selection of forms, or strategies, or apply the law to the facts of your particular situation. If legal advice is required, you should engage an attorney.

No attorney-client, fiduciary, or similar professional relationship is created by your use of the Website, your use of the software, or communications with our support team.

Any reliance you place on the information provided in this Website, whether you engage an attorney or not, is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Website, or by anyone who may be informed of any of its contents.

All statements and/or opinions expressed in these materials, and all articles and responses to questions and other content, other than the content provided by the Company, are solely the opinions and the responsibility of the person or entity providing those materials. These materials do not necessarily reflect the opinion of the Company. We are not responsible, or liable to you or any third party, for the content or accuracy of any materials provided by any third parties.

Information About You and Your Visits to the Website

All information we collect on this Website is subject to our Privacy Policy (https://simplewaivers.com/privacy-policy.html). By using the Website, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.

Waiver Retention and Deletion

While your account has an active paid subscription (Starter, Pro, Unlimited, Archive, or an earlier paid plan), we keep your signed waiver records and their PDF copies for as long as the subscription stays active.

On a free account, on an Event Pass, or after a paid subscription ends, a signed waiver record and its PDF may be deleted once it is 18 months old, but not earlier than 90 days after your paid subscription ended. We may keep records longer than these periods, and we will not delete records that we are required by law to keep or that we know are subject to a legal hold, dispute, or claim. When email delivery is configured, we may send a reminder to the host account on file about 30 days before a waiver is scheduled for deletion. We do not send retention notices to guests, and email delivery is not guaranteed. Any reminder email is a courtesy only and is not legal notice or proof of record availability.

You are responsible for keeping your own copies. You are solely responsible for downloading, exporting, and maintaining copies of completed waivers (including PDFs) for your records and for any legal, insurance, or compliance needs. Do not rely on Simple Waivers as your only storage or recordkeeping system. We are not responsible for any loss of access to a waiver or waiver PDF after deletion, or for any loss resulting from your failure to download or export a copy before the retention period ends.

Third-Party Service Provider; Online Purchases; Other Terms and Conditions

We use Stripe, Inc. and its affiliates as the third-party service provider for payment services (a “Third-Party Service Provider”). By subscribing to our Website, you agree to be bound by Stripe’s End User Terms (https://stripe.com/legal/consumer) and hereby consent and authorize Company and Stripe to share any information and payment instructions to the minimum extent required to complete your transactions.

Plans, Subscriptions, Billing, and Refund Policy

Simple Waivers offers a free plan, monthly subscriptions, and a one-time Event Pass. Current plan limits and prices are shown on our sign-up page.

Free plan. A free account may collect up to 10 signed waivers per month and keep 1 active event. No payment method is required. We may change or end the free plan by posting notice on the Website; waivers you have already collected remain subject to the Waiver Retention and Deletion section above.

Event Pass. An Event Pass is a one-time payment, not a subscription, and does not renew. It covers one event, up to 150 signed waivers, for 90 days from purchase. The pass attaches to the first of your events where a waiver is signed after purchase. Unused waivers and unused time are not refunded, extended, or carried over. You may request a full refund of an Event Pass if no waiver has been signed under it, by contacting support@simplewaivers.com. Once a waiver has been signed under the pass, the pass is non-refundable except where required by law. A refunded pass stops working.

Archive. Archive is a monthly subscription for keeping past records. While on Archive you can sign in, look up, and download your signed waivers, and they are kept as described in the Waiver Retention and Deletion section above. Archive does not allow new events or new signatures.

Subscriptions. By purchasing a subscription, you authorize us to charge your selected payment method on a recurring basis until you cancel.

Subscriptions renew automatically at the end of each billing period unless canceled prior to the renewal date. You may cancel your subscription at any time through your account dashboard. Cancellation will take effect at the end of the current billing period, after which your account continues on the free plan.

We offer a 30-day money-back guarantee for first-time subscribers on their initial subscription purchase. To request a refund, contact support@simplewaivers.com within 30 days of the initial charge.

After the 30-day guarantee period, and except where required by law, subscription fees are non-refundable. We do not provide refunds or credits for partial billing periods, unused time, or unused features. If you believe you were charged in error, please contact support@simplewaivers.com and we will review the issue.

Additional refund eligibility details are available in our Refund Policy (https://simplewaivers.com/refund-policy), which is incorporated by reference into these Terms.

We reserve the right to change subscription pricing or billing terms with advance notice as required by applicable law.

Additional terms and conditions may also apply to specific portions, services, or features of the Website. All such additional terms and conditions are hereby incorporated by this reference into these Terms of Use.

Affiliate Program

If you participate in the Simple Waivers affiliate program, you agree to promote the service in good faith and not engage in fraudulent, misleading, or abusive referral activity.
