Information About You and Your Visits to the Website

Waiver Retention and Deletion

Signed waiver records and associated PDF copies are retained for 18 months from creation. After that period, the waiver record and its PDF are deleted. When email delivery is configured, we may send a reminder to the host account on file about 30 days before a waiver is scheduled for deletion. We do not send retention notices to guests, and email delivery is not guaranteed. Any reminder email is a courtesy only and is not legal notice or proof of record availability.

You are responsible for keeping your own copies. You are solely responsible for downloading, exporting, and maintaining copies of completed waivers (including PDFs) for your records and for any legal, insurance, or compliance needs. Do not rely on Simple Waivers as your only storage or recordkeeping system. We are not responsible for any loss of access to a waiver or waiver PDF after deletion, or for any loss resulting from your failure to download or export a copy before the retention period ends.

Third-Party Service Provider; Online Purchases; Other Terms and Conditions

We use Stripe, Inc. and its affiliates as the third-party service provider for payment services (a “Third-Party Service Provider”). By subscribing to our Website, you agree to be bound by Stripe’s End User Terms (https://stripe.com/legal/consumer) and hereby consent and authorize Company and Stripe to share any information and payment instructions to the minimum extent required to complete your transactions.

Subscriptions, Billing, and Refund Policy

Simple Waivers is a subscription-based service. By purchasing a subscription, you authorize us to charge your selected payment method on a recurring basis until you cancel.

Subscriptions renew automatically at the end of each billing period unless canceled prior to the renewal date. You may cancel your subscription at any time through your account dashboard. Cancellation will take effect at the end of the current billing period.

Except where required by law, subscription fees are non-refundable. We do not provide refunds or credits for partial billing periods, unused time, or unused features. If you believe you were charged in error, please contact support@simplewaivers.com and we will review the issue.

We reserve the right to change subscription pricing or billing terms with advance notice as required by applicable law.

Additional terms and conditions may also apply to specific portions, services, or features of the Website. All such additional terms and conditions are hereby incorporated by this reference into these Terms of Use.

Affiliate Program

If you participate in the Simple Waivers affiliate program, you agree to promote the service in good faith and not engage in fraudulent, misleading, or abusive referral activity. Fraudulent, misleading, or abusive referral activity includes any attempt to manipulate, misrepresent, or improperly generate referrals or commissions, and Simple Waivers reserves the right to withhold commissions, suspend affiliate access, or terminate accounts for violations of these Terms.

Linking to the Website and Social Media Features

You may link to our homepage, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part without our express consent.

The Terms of Use, our Privacy Policy, constitute the sole and entire agreement between you and Simple Waivers, LLC regarding the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website.
